Terms of Service

1. Acceptance of Terms

By accessing or using GeoMine (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. GeoMine is operated by GeoMine Inc. (“we,” “us,” or “our”).

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use GeoMine. By using the Service, you represent and warrant that you meet these requirements.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access.

4. Mining Services

GeoMine allows users to earn $GMINE tokens by physically visiting participating businesses. By using the mining feature, you agree to:

• Allow GeoMine to access your device's GPS location during active mining sessions.
• Physically be present at the business location — GPS spoofing or mock locations are prohibited.
• Not use emulators, rooted/jailbroken devices, or any other tools to falsify your location.
• Comply with the minimum 15-minute dwell time and 2-hour cooldown per business.
• Accept that mining rates and reward calculations are at our sole discretion.

5. $GMINE Tokens

$GMINE tokens are digital assets earned through the GeoMine platform. Important notices:

• $GMINE tokens are not securities, commodities, or investment contracts.
• The value of $GMINE tokens may fluctuate and is not guaranteed.
• We make no promises regarding the future value or tradability of $GMINE tokens.
• Token balances may be adjusted in cases of confirmed fraud or system errors.
• We reserve the right to modify the emission schedule with reasonable notice.

6. Business Subscriptions

Business accounts are subject to monthly subscription fees. Subscriptions are billed in advance and are non-refundable. You may cancel at any time, and your subscription will remain active until the end of the current billing period.

7. Prohibited Conduct

You agree not to:

• Use GPS spoofing, mock locations, or location falsification of any kind.
• Create multiple accounts to circumvent cooldown or other restrictions.
• Use automated tools, bots, or scripts to interact with the Service.
• Attempt to exploit, hack, or reverse-engineer any part of the platform.
• Interfere with or disrupt the Service or its infrastructure.
• Violate any applicable local, state, national, or international law.

8. Termination

We may suspend or terminate your account at any time for violation of these terms, suspected fraud, or any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. Earned but unspent tokens may be forfeited in cases of terms violations.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEOMINE INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR TOKENS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Wilmington, Delaware.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or in-app notification at least 30 days before the changes take effect. Continued use after the effective date constitutes acceptance.
